Hereinafter, "ContinuumAI" or "the Company".
2. DEFINITIONS
For the purposes of this document:
- "Personal Data" means any information that identifies or can identify a person.
- "Customer" means the individual user or entity using the Platform.
- "Data Processor" (Processor) means ContinuumAI when it processes data on behalf of the Customer.
- "Data Controller" (Controller) means the Customer with respect to the data they enter into the Platform.
- "Subprocessor" means any third party that processes data on behalf of ContinuumAI.
- "Platform" means continuumai.app.
3. DATA PROTECTION ROLES
In the context of business use:
- The Customer acts as the Data Controller.
- ContinuumAI acts as the Data Processor.
For account and billing data, ContinuumAI acts as an independent Controller.
4. CATEGORIES OF DATA PROCESSED
ContinuumAI may process:
Identification Data
- Name
- Authentication information
Technical Data
- IP address
- Device data
- Access logs
Data Entered by the Customer
- Conversations
- Documents
- Images
- Videos
- Audio
- Generated content
- Business information
Sensitive Data
ContinuumAI does not deliberately request sensitive data, but the Customer may enter it at their own risk.
5. PURPOSE OF PROCESSING
Data is processed exclusively to:
- Provide artificial intelligence services
- Maintain contextual coherence
- Multimodal generation (text, image, video, audio)
- Security and abuse prevention
- Billing and support
- Regulatory compliance
ContinuumAI does not sell personal data.
6. CONFIDENTIALITY
ContinuumAI implements strict confidentiality policies:
- Limited access based on the principle of least privilege
- Confidentiality agreements with employees and contractors
- Contractual protection with subprocessors
- Restriction of administrative access to customer content
Private content is not used for external commercial purposes.
7. TECHNICAL AND ORGANIZATIONAL MEASURES
ContinuumAI implements measures such as:
- Encryption in transit (TLS/HTTPS)
- Role-based access controls
- Secure authentication
- Event logging
- Security monitoring
- Environment segmentation
- Protection against unauthorized access
No system can guarantee absolute security.
8. SUBPROCESSORS
ContinuumAI may use subprocessors for:
- Cloud infrastructure
- Payment processing
- Authentication
- Storage services
- External AI model services
All subprocessors are subject to contractual agreements that require:
- Adequate data protection
- Confidentiality
- Regulatory compliance
9. INTERNATIONAL TRANSFERS
Data may be transferred outside the Customer's country of origin.
When GDPR applies:
- Standard Contractual Clauses (SCC) will be used
- Reasonable supplementary measures will be applied
The Customer accepts such transfers by using the service.
10. DATA RETENTION
Data will be retained:
- While the account is active
- As long as necessary for contractual purposes
- In accordance with legal obligations
The Customer may request data deletion.
11. DATA SUBJECT RIGHTS (GDPR / CCPA READY)
Depending on the jurisdiction, data subjects may exercise the right to:
- Access
- Rectification
- Erasure
- Restriction
- Objection
- Portability

12. SECURITY INCIDENT NOTIFICATION
In the event of an incident affecting personal data:
- ContinuumAI will notify the Customer without undue delay
- Provide reasonable information about the scope
- Adopt corrective measures
13. CUSTOMER INSTRUCTIONS
ContinuumAI will only process data in accordance with:
- Documented instructions from the Customer
- Current contract
- Applicable legislation
14. AI-RELATED LIMITATIONS
The Customer acknowledges that:
- AI systems may generate inaccurate results
- The platform does not replace human review
- The Company does not guarantee exclusivity of the generated content
- AI may produce similar results for different users
15. NO EXTERNAL TRAINING WITHOUT CONSENT
ContinuumAI does not use private Customer content for:
- Training external models
- Data commercialization
Unless explicit consent or a different contractual provision exists.
16. INDEMNIFICATION
The Customer will indemnify ContinuumAI against claims arising from:
- Misuse of the Platform
- Input of data without legal basis
- Violation of third-party rights
17. LIMITATION OF LIABILITY
ContinuumAI's total liability is limited to the amount paid by the Customer in the last 12 months.
In no event will it be liable for indirect damages, loss of revenue, or loss of profits.
18. REGULATORY COMPLIANCE
This document is designed to align with:
- US Federal Laws
- CCPA (California Consumer Privacy Act)
- GDPR (General Data Protection Regulation of the EU)
- International personal data protection best practices
19. MODIFICATIONS
ContinuumAI may update this document at any time.
Continued use implies acceptance of changes.
